On May 5, 2023, Governor Brian Kemp signed Senate Bill 92 into law, creating the Prosecuting Attorneys Qualification Commission.
The commission can investigate and discipline or remove elected district attorneys or solicitors-general in specific instances, including if they consistently fail to fulfill their duties. It also clarifies the duties of prosecuting attorneys, specifically including language that they must review every case with probable cause for prosecution.
The Prosecuting Attorneys Qualification Commission comprises two panels: an investigative panel of five attorneys and a hearing panel of three attorneys. The governor, the lieutenant governor, the speaker of the Georgia House of Representatives and the Georgia Senate Committee on Assignments will have appointing authority for commission members.
