Feds reach settlement agreement with Smyrna daycare program

The United States Attorney’s Office for the Northern District of Georgia has settled with a Smyrna, Georgia, child care to resolve allegations that it violated the Americans with Disabilities Act by denying a child an opportunity to participate in its daycare program based on his autism.

Smarter Kids Child Care will adopt a non-discrimination policy to ensure ADA compliance, the feds said. It will also provide mandatory training for all employees considering requests for reasonable accommodations or making enrollment decisions.

Additionally, Smarter Kids will pay $7,000 in compensation to the complainant and $1,000 to the United States as a civil penalty.
